1. Acceptance of Terms

Welcome to blessoin. These Terms and Conditions govern your use of our website and the residence services we provide. By accessing our website or engaging our services, you agree to be bound by these terms.

If you do not agree with any part of these terms, please do not use our website or services. These terms constitute a legally binding agreement between you and blessoin.

2. Definitions

In these Terms and Conditions:

  • "We," "Us," "Our" refers to blessoin, operating at Jalan Sultan Abdul Samad 56, 50000 Kuala Lumpur, Wilayah Persekutuan, Malaysia
  • "Services" refers to senior residence services including accommodation, meals, housekeeping, activities, and support as detailed in our residence levels
  • "Resident" refers to the individual receiving residence services
  • "Family" or "You" refers to the resident, their family members, authorized representatives, or legal guardians
  • "Agreement" refers to the residence agreement signed between blessoin and the resident or their authorized representative
  • "Website" refers to our website at blessoin.live

3. Eligibility and Admission

Our residence services are designed for seniors who can benefit from supportive living arrangements. Admission is subject to:

  • Availability of appropriate accommodation in the requested residence level
  • Completion of required documentation and information sharing
  • Assessment confirming that our services align with the individual's needs and preferences
  • Agreement to our terms and payment arrangements

We reserve the right to determine whether our services are appropriate for an individual based on their needs, our capacity, and our ability to provide safe and suitable care.

4. Services Provided

blessoin provides senior residence services across three levels: Spring Residence, Autumn Residence, and Golden Residence. Each level includes different combinations of:

  • Private accommodation appropriate to the residence level
  • Daily meal service with dietary accommodation
  • Housekeeping and laundry services
  • Activity programs and community opportunities
  • Personal assistance and support as applicable to the residence level
  • Access to common areas and facilities

Specific services included in each residence level are detailed in our service descriptions and residence agreements. We do not provide medical services or skilled nursing care.

5. Fees and Payment

Residence fees are charged monthly and include the services specified for each residence level. Current fees are:

  • Spring Residence: RM 3,050 per month
  • Autumn Residence: RM 7,150 per month
  • Golden Residence: RM 11,650 per month

Payment Terms:

  • Fees are due by the first day of each month
  • Payment may be made by bank transfer, cheque, or other agreed methods
  • Late payments may incur administrative charges
  • We reserve the right to adjust fees with 60 days written notice

All fees are in Malaysian Ringgit (RM). Additional services not included in the residence fee may be available for separate charges.

6. Termination and Refunds

Termination by Family:

  • Either party may terminate the residence agreement with 30 days written notice
  • Fees are prorated for partial months based on actual days of residence
  • Deposits, if any, are refundable upon satisfactory condition of accommodation and settlement of outstanding fees

Termination by blessoin:

We may terminate the residence agreement with 30 days notice, or immediately in cases involving:

  • Non-payment of fees after reasonable notice
  • Behavior that compromises safety or well-being of other residents or staff
  • Significant changes in needs that we cannot safely or appropriately meet
  • Breach of residence policies or these terms

In all termination scenarios, we will work with families to facilitate appropriate transitions.

7. Resident Rights and Responsibilities

Residents have the right to:

  • Be treated with dignity and respect
  • Privacy in their personal space and information
  • Make their own decisions about daily routines and activities
  • Have visitors at reasonable times
  • Express concerns and provide feedback
  • Access their personal information

Residents are responsible for:

  • Treating staff and other residents with respect
  • Following residence policies and safety guidelines
  • Providing accurate information about health, preferences, and emergency contacts
  • Maintaining personal belongings appropriately
  • Communicating needs and concerns

8. Personal Belongings

Residents are welcome to bring personal belongings to their accommodation. However:

  • We recommend insuring valuable items through personal insurance
  • blessoin is not liable for loss, damage, or theft of personal property
  • We reserve the right to request removal of items that pose safety concerns
  • Items left after termination of residence will be stored for 30 days before disposal

9. Privacy and Confidentiality

We respect the privacy of residents and families. Our handling of personal information is governed by our Privacy Policy and the Personal Data Protection Act 2010 (Malaysia).

Residents or their authorized representatives control information sharing with family members and others.

10. Limitation of Liability

To the fullest extent permitted by law:

  • blessoin provides services with reasonable care and skill but does not guarantee specific outcomes
  • We are not liable for indirect, consequential, or incidental damages
  • Our liability for any claim is limited to the fees paid for services during the three months prior to the claim
  • Nothing in these terms excludes liability that cannot be excluded under Malaysian law

We maintain appropriate insurance coverage for our operations.

11. Website Use

When using our website, you agree to:

  • Use the website for lawful purposes only
  • Not attempt to gain unauthorized access to our systems
  • Not transmit harmful code or interfere with website operation
  • Respect intellectual property rights in website content

Website content is provided for informational purposes. While we strive for accuracy, information may change and should be verified through direct contact.

12. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of blessoin or used with permission. You may view and print website content for personal, non-commercial use but may not reproduce, distribute, or modify it without our written permission.

13. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, utility failures, or public health emergencies. In such events, we will make reasonable efforts to continue providing services or arrange appropriate alternatives.

14. Dispute Resolution

We encourage open communication to resolve any concerns or disputes. If concerns cannot be resolved through direct discussion:

  • Concerns should be submitted in writing to our management
  • We will respond within 14 days with our investigation and proposed resolution
  • If informal resolution is unsuccessful, parties may pursue mediation before litigation

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Changes to Terms

We may update these Terms and Conditions periodically. Changes will be posted on our website with a revised "Last Updated" date. Significant changes affecting current residents will be communicated directly. Continued use of our services after changes indicates acceptance of updated terms.

18. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any signed residence agreement, constitute the entire agreement between you and blessoin regarding our services and supersede all prior communications and proposals.
